It would still be illegal, because the Poser 4 upgrade was sent, yes *free*,
but more than likely as a 'pre-order' free upgrade from his Academic version
3 to what would effectively become an Academic version 4 Pro... H3 couldn't
then use his version 3 to upgrade to something else, because that license
has been replaced by the version 4 upgrade, so he could not sell that and
keep the version 4 either.

If he had BOUGHT an upgrade from Academic to COMMERCIAL license, then,
depending on publishers license terms, he may be allowed to sell the
upgrade.  Some publishers allow this, only if you sign a declaration to
state you retain no copies, either physical or installed....  other
publishers won't allow 'upgrades' to be transferred to new owners, some
will...
but it sounds in this case as if the upgrade is still classed as Academic,
and therefore still not transferable, especially as it was sent 'free' on
the probably basis that he did a 'buy version 3 now and get a free upgrade
to 4 on release'....

As I say, it can be different for each publisher, but this is the typical
scenario...

Sure that's illegal? If he sold the C4Pro alone, I don't think it would be,
since it was sent free by the folks at Eovia. Just my 2 cents.
